Behold | Terms of Use

Introduction

Welcome to Behold. These Terms of Use (“Terms”) govern your access to and use of the Behold mobile application (“App”) and related services provided by Next Wave Apps (“we,” “us,” or “our”).

By downloading or using Behold, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

Please also review our Privacy Policy, which explains how we handle data and privacy.

Eligibility and Age Requirements

You must be at least 13 years old to use Behold.

If you are between 13 and 16 years of age, you may use the App only with the consent of a parent or legal guardian.

By using the App, you represent and warrant that you meet these age requirements.

No Accounts Required

Behold does not require account creation.

All app data is stored locally on your device
We do not create or maintain user accounts
You are responsible for managing your device and app settings

Subscription status is handled by Apple and Superwall and made available to the app without requiring an account.

Acceptable Use

When using Behold, you agree not to:

Attempt to bypass, disable, or interfere with app restrictions or focus features
Circumvent Apple Screen Time, FamilyControls, or ManagedSettings safeguards
Reverse engineer, decompile, or disassemble the App
Modify, copy, or create derivative works of the App
Use the App for unlawful or harmful purposes
Attempt unauthorized access to systems or infrastructure
Use the App in a way that disrupts or degrades its functionality

You agree to use Behold responsibly and in accordance with applicable laws.

Subscriptions and Payments

Available Plans

Behold offers:

Free access to core functionality in limited fashion
Behold Plus that unlocks feature limits and additional features

Subscription options may include:

Weekly
Monthly
Yearly

Billing and Renewal

Subscriptions are billed in advance
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
Charges are processed through the Apple App Store

Managing Your Subscription

You can manage or cancel your subscription through:

Behold does not manage billing details directly.

Price Changes

We may update subscription prices from time to time. Any changes will apply only to future billing periods and will be communicated in advance where required by law.

Refunds

App Store Purchases

All in-app purchases are processed by Apple. Refund requests are subject to Apple’s policies and must be requested through your Apple account or Apple Support.

Next Wave Apps cannot issue refunds for App Store purchases.

Apple App Store Terms

The following terms apply to your use of Behold when downloaded through the Apple App Store.

Agreement with Next Wave Apps

You acknowledge that these Terms are concluded between you and Next Wave Apps only, and not with Apple Inc. ("Apple"). Next Wave Apps, not Apple, is solely responsible for Behold and its content.

These Terms do not conflict with the Apple Media Services Terms and Conditions.

License Scope

Subject to these Terms, Next Wave Apps grants you a limited, non-transferable license to use Behold on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This license also permits access and use by other accounts associated with you via Family Sharing or volume purchasing.

You may not distribute, sublicense, or transfer this license to any third party.

Maintenance and Support

Next Wave Apps is solely responsible for providing maintenance and support services for Behold, as specified in these Terms or as required by applicable law.

You acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services for Behold.

Warranty

Next Wave Apps is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms.

If Behold fails to conform to any applicable warranty:

You may notify Apple, and Apple will refund the App purchase price (if any) to you
To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Behold
Any other claims, losses, liabilities, damages, costs, or expenses arising from warranty failures are the sole responsibility of Next Wave Apps

Product Claims

You acknowledge that Next Wave Apps, not Apple, is responsible for addressing any claims you or any third party may have relating to Behold or your use of it, including but not limited to:

Product liability claims
Claims that Behold fails to conform to applicable legal or regulatory requirements
Claims arising under consumer protection, privacy, or similar legislation, including claims related to Behold's use of Apple's Screen Time, FamilyControls, ManagedSettings, and DeviceActivity frameworks

Nothing in these Terms limits Next Wave Apps' liability to you beyond what is permitted by applicable law.

Intellectual Property Claims

You acknowledge that if any third party claims that Behold or your use of Behold infringes that third party's intellectual property rights, Next Wave Apps, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance

By using Behold, you represent and warrant that:

You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
You are not listed on any U.S. Government list of prohibited or restricted parties

Third-Party Terms

You must comply with all applicable third-party terms and agreements when using Behold. For example, you must not violate your wireless data service agreement when using the App.

Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

App Functionality and Limitations

Screen Time & Focus Features

Behold uses Apple’s Screen Time, FamilyControls, ManagedSettings, and DeviceActivity APIs to provide focus and presence features.

You acknowledge that:

You choose which apps are restricted and when
You may revoke Screen Time permissions at any time in device settings
These features rely on Apple’s system APIs and may be affected by OS behavior or limitations

No Guarantees of Outcome

Behold provides tools to support intentional technology use. However:

We do not guarantee behavior change, productivity gains, or wellbeing outcomes
Effectiveness depends on personal usage and system constraints

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will always function without interruption
All features will be error-free
Features will remain unchanged or available indefinitely

No Professional Advice

Behold is a digital wellbeing tool. It does not provide medical, psychological, therapeutic, or professional advice.

If you experience distress, addiction, or mental health concerns, please seek help from a qualified professional.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT WAVE APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

Loss of data
Loss of revenue or profits
Loss of goodwill
Business interruption

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Intellectual Property

Our Rights

The App, its design, content, features, and branding are owned by Next Wave Apps and protected by intellectual property laws.

You may not:

Copy, distribute, or modify the App
Use our trademarks without permission
Remove proprietary notices

Your Content

Any content you create within Behold remains stored locally on your device and remains yours.

You grant us a limited, non-exclusive license to process such content only as necessary to provide App functionality on your device.

Termination

By You

You may stop using Behold at any time by deleting the App from your device.

By Us

We may restrict or discontinue access to the App if:

These Terms are violated
The App must be discontinued for legal, technical, or business reasons

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of The Netherlands.

Dispute Resolution

EU residents: You may bring claims in your country of residence and contact your local consumer authority
Non-EU residents: Disputes shall be resolved in the courts of Rotterdam, The Netherlands

We encourage informal resolution by contacting us first.

Changes to These Terms

We may update these Terms from time to time.

The “Last Updated” date will reflect changes
Material changes may be communicated via the App or website
Continued use after changes take effect constitutes acceptance

Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Next Wave Apps regarding Behold.
